Members of the Nairobi County Assembly (MCAs) have turned their focus to senior county officials serving in acting capacities, demanding their removal over allegations of overstaying beyond the legally permitted period and questions surrounding their academic qualifications.
The MCAs argue that several top officers appointed in acting roles have exceeded the six-month limit stipulated under the Public Service Commission (PSC) Act, rendering their continued stay in office unlawful. They insist that any officer serving without proper documentation must vacate office immediately.
Among those singled out for removal are Acting County Secretary Godfrey Akumali, Acting Head of Parking Stephen Ogesa, and Acting Chief Officer for the County Inspectorate Eva Wangechi Wairiuko.
An MCA sponsoring a statement on the matter, who requested anonymity, said the Assembly would take decisive action once sittings resume.
“We shall deal with them strictly according to the law. We will not sit back and watch as illegalities continue to be perpetrated by the County Executive,” the MCA said.
Questions Over Academic Qualifications
Beyond the legality of acting appointments, MCAs have also raised concerns over the academic qualifications of Stephen Ogesa and Eva Wairiuko. The Assembly is now pushing for the Labour Committee to investigate claims that the two may not possess the requisite academic credentials for their respective positions.
The statement is expected to be formally tabled when the House reopens on February 8.
Lawmakers further warned that the matter could be escalated to the Ethics and Anti-Corruption Commission (EACC) should investigations confirm any irregularities.
“We know them, and we will not hesitate to report the matter to the EACC to demand thorough investigations. Enough is enough. If it is established that they lacked the required qualifications, they must refund all salaries earned,” the MCA added.
The latest development piles further pressure on Governor Johnson Sakaja’s administration, which has in recent months faced heightened scrutiny from the County Assembly over governance, accountability, and compliance with public service laws.
